9 NYCRR 448.4 (a)
All floating objects having no navigational, informational or regulatory purposes such as swimming and diving floats, ski jumps, etc., shall be painted white and equipped with white reflector tape in such a manner that it can be seen from any direction.
If such objects are authorized for placement in excess of 100 feet from shore, the commissioner may require they be equipped with a fixed white light to show all around the horizon for a distance of at least one-half mile.
It is also important to note, a floating object permit is not needed for a land owner to place a single raft less than 100 sq ft within 100 ft of shore or a mooring buoy within 100 ft of shore. Anything not meeting those criteria requires a permit. The permit is where we start looking at any additional safety requirements that may be needed. Floating objects can’t create a hazard to navigation or hinder access to someone else’s property.
